Introduction

These Terms & Conditions ("Agreement") govern all recruitment, manpower supply, work-permit management, and executive search services provided by VERO Staffing Agency ("we", "us", "our", "VERO") to employers, businesses, recruitment agencies, and job seekers ("you", "the client", "the candidate") in the Maldives and internationally.

By engaging with VERO's services—whether through our website, email, WhatsApp, phone, or in-person—you acknowledge that you have read, understood, and agree to be legally bound by these terms.

Important Notice

If you do not agree with any part of these terms, please do not use our services. Continued use of VERO's services constitutes acceptance of these terms.

Licensing & Compliance

VERO Staffing Agency is a fully licensed and registered manpower recruitment service provider operating under the laws of the Maldives.

Licensed & Authorized

We hold a Category B License issued by the Government of Maldives, authorizing us to:

  • Recruit and manage foreign workers
  • Process work permits and visas via the XPAT system
  • Provide expat management services
  • Coordinate with international recruitment agencies

We strictly comply with:

  • Maldives Immigration requirements and regulations
  • XPAT work permit procedures and guidelines
  • Maldivian Employment Act and labor laws
  • International ethical recruitment standards
  • Data protection and privacy regulations

Service Fees & Payment Structure

VERO operates on a dual payment model depending on the recruitment scenario and client type:

Payment Models

Model A: Agency/Candidate Pays (Standard Recruitment)

  • For regular placements where candidates are sourced through international agencies or agents
  • The recruitment agency or agent (on behalf of the candidate) pays VERO's service fees
  • Fees cover processing, documentation, visa support, and placement services
  • Payment terms and amounts are agreed upon before processing begins

Model B: Employer Pays (Specialized Recruitment)

  • For specialized, professional, or executive-level placements
  • When employers require specific nationalities (e.g., Filipino, Indonesian, Myanmar professionals)
  • For high-volume or urgent recruitment projects
  • Standard fee: USD $500 per candidate (subject to variation based on requirements)
  • Fees may vary depending on position level, industry, urgency, and sourcing complexity

Payment Terms:

  • All fees and payment schedules will be clearly communicated in writing before work commences
  • Payments are non-refundable once recruitment or documentation work has started
  • Third-party costs (government fees, visa fees, medical tests, insurance, quota deposits, etc.) are the responsibility of the employer or agency as applicable
  • Invoices must be paid within the agreed timeline to avoid service delays
  • Late payments may result in suspension of services until payment is received
Important Payment Notice

No refunds will be issued for services already rendered, including but not limited to candidate sourcing, screening, document collection, and processing work. Refunds are only applicable under the specific conditions outlined in Section 10 (Refund Policy).

Recruitment Scope & Countries

VERO specializes in sourcing qualified candidates from the following countries for employment opportunities in the Maldives:

We maintain an extensive network of verified recruitment partners, agencies, and candidate databases across these countries to provide diverse talent pools across all skill levels and industries.

Destination: All our recruitment services are exclusively for employment opportunities within the Maldives. We do not facilitate overseas placements outside of the Maldives.

Employer & Client Responsibilities

By engaging VERO's services, employers and clients agree to the following responsibilities:

  • Accurate Job Requirements: Provide complete, truthful, and accurate information about job positions, roles, responsibilities, salary, benefits, working conditions, and employment terms
  • Timely Documentation: Submit all required employer documents, company registration, licenses, and XPAT-related paperwork in a timely manner
  • Legal Compliance: Ensure full compliance with Maldivian Immigration laws, Employment Act, labor regulations, and work permit requirements
  • Fee Payment: Pay all agreed service fees on time as per the payment schedule outlined in the service agreement
  • Government Fees: Cover all third-party costs including but not limited to visa fees, medical examinations, quota deposits, insurance, and government processing charges
  • Ethical Treatment: Treat all recruited employees fairly, ethically, and in accordance with Maldivian labor law and international human rights standards
  • Accommodation & Welfare: Provide suitable accommodation, food, and working conditions as agreed in the employment contract
  • Employment Contracts: Issue proper employment contracts compliant with Maldivian law
  • Change Letters: In cases where staff replacement is needed, provide an official change letter to facilitate the transfer of employment
  • Communication: Maintain open and timely communication with VERO regarding any issues, changes, or updates related to recruited staff
Employer Accountability

Failure to fulfill these responsibilities may result in visa rejections, work permit denials, legal complications, or termination of services by VERO. The employer is solely responsible for any consequences arising from incomplete, inaccurate, or delayed submissions.

Data Collection, Documentation & Privacy

As part of our recruitment and work permit processing services, VERO collects, processes, and manages various personal and professional documents from candidates and recruitment agencies.

Documents We Collect (from candidates via agencies):

  • Passport copy (biographical page with photo and details)
  • White background passport-sized photograph (for visa applications)
  • Recent color photographs
  • Comprehensive resume/CV with employment history
  • Educational certificates and diplomas
  • Professional certifications and training documents
  • Experience letters from previous employers
  • Police character certificate / Good conduct certificate
  • Medical fitness certificates (as required)
  • Trade test certificates (for skilled workers)
  • Working videos demonstrating skills (for specific categories)
  • Self-introduction videos (for certain positions)
  • Any other documents required by employers or government authorities
Data Sharing & Third Parties

Who We Share Candidate Data With:

  • Prospective Employers: We share candidate profiles, documents, and videos with potential employers in the Maldives for evaluation and hiring decisions
  • Third-Party Agencies & Agents: We collaborate with international recruitment agencies and agents who source candidates on our behalf
  • Government Authorities: We submit required documentation to Maldives Immigration, XPAT, and other relevant government bodies for visa and work permit processing

Data Protection & Security:

  • We handle all personal data with strict confidentiality and in compliance with applicable data protection regulations
  • Documents are stored securely and accessed only by authorized personnel
  • We do not sell, rent, or distribute candidate data to unauthorized third parties
  • Candidates have the right to request updates or corrections to their information

Document Verification:

  • VERO conducts reasonable verification of submitted documents based on information provided by agencies and candidates
  • We perform background checks, reference checks, and skill assessments as applicable
  • However, VERO is not responsible for false, forged, or intentionally misleading information provided by candidates or external agencies
  • The final responsibility for document authenticity lies with the candidate and the sourcing agency

XPAT Management & Work Permit Processing

VERO provides comprehensive support for work permit applications and expat management through the XPAT system—the official Government of Maldives platform for foreign worker management.

  • Document upload and verification support
  • Quota management assistance
  • Visa application coordination (informational guidance only)
  • Permit renewals and extensions
  • Status tracking and updates
  • Liaison with Immigration authorities when necessary

XPAT Submission Requirements:

Work permit processing through XPAT requires accurate and complete information from both the employer and the candidate. VERO assists with submissions based on:

  • Employer-provided company documents, licenses, and registration details
  • Candidate documents verified and collected through our recruitment process
  • Job descriptions, salary details, and employment contract terms
  • Quota availability and allocation from the employer's XPAT account
Limitation of Liability - Government Processing

VERO shall NOT be held responsible for:

  • Delays or rejections caused by incomplete or incorrect employer documents
  • XPAT quota limitations or quota unavailability
  • Government processing delays beyond our control
  • Immigration policy changes or new regulatory requirements
  • Visa application rejections by Maldives Immigration
  • Errors in information provided by employers or candidates
  • Third-party delays in medical tests, background checks, or attestations
  • Immigration or visa issues arising from government decisions

While we provide professional support and guidance, final decisions on work permits and visas rest with the Maldives Immigration Department and relevant government authorities. VERO's role is facilitation and coordination only.

Staff Replacement Policy

VERO is committed to ensuring client satisfaction and successful placements. If issues arise with recruited staff, we offer replacement services under the following conditions:

Replacement Guarantee

When Replacement is Provided:

  • Staff demonstrates poor work performance not matching their stated qualifications
  • Behavioral or disciplinary issues that make continued employment untenable
  • Skills or experience significantly misrepresented in the application
  • Medical or health issues preventing the employee from fulfilling their duties
  • Mutual agreement between employer and VERO that replacement is necessary

Replacement Process & Requirements:

  • The employer must notify VERO in writing of the performance or behavioral issues within a reasonable timeframe
  • The employer must provide supporting documentation or evidence of the problem
  • The employer must issue an official change letter (employment transfer letter) to facilitate the visa and work permit transfer process
  • VERO will source a suitable replacement candidate from our database or recruitment network
  • The replacement candidate will be subject to the same screening and verification process
  • Replacement timelines depend on candidate availability, visa processing, and country of origin
Change Letter Requirement

In certain cases, employers must provide an official change letter to transfer the employment sponsorship from the original candidate to the replacement. This is a legal requirement for work permit changes in the XPAT system. VERO will guide employers through this process.

Conditions & Limitations:

  • Replacement terms may vary based on the recruitment agreement, country of origin, job category, and specific circumstances
  • Additional government fees (visa, medical, etc.) for the replacement candidate are the employer's responsibility
  • Replacement is subject to candidate availability and may take time depending on sourcing requirements
  • Employers cannot request unlimited replacements; terms will be agreed upon in the service contract
  • If the issue is due to employer mismanagement, unclear job expectations, or workplace conditions, VERO reserves the right to decline replacement

Refund & Cancellation Policy

VERO's refund policy is designed to be fair and transparent, balancing client needs with the work already performed by our team.

Full Refund Scenarios

You are entitled to a full refund if:

  • VERO is unable to secure a work permit or visa for the candidate despite best efforts and proper documentation
  • The visa application is rejected by Maldives Immigration due to reasons beyond the candidate's or employer's control
  • VERO fails to source a suitable candidate within the agreed timeframe and service scope
  • Services are cancelled before any recruitment or processing work has commenced
No Refund Scenarios

Refunds will NOT be provided if:

  • Recruitment, candidate sourcing, screening, or documentation work has already begun
  • VERO has invested time and resources in processing your request
  • The candidate or agency cancels after visa approval or work permit issuance
  • The candidate refuses to travel or changes their mind after processing
  • The employer cancels the job offer or changes requirements mid-process
  • Visa rejection is due to incorrect, incomplete, or false information provided by the candidate or employer
  • Government fees, third-party costs, or non-refundable expenses have been incurred

Cancellation by Candidate or Agency:

  • If the candidate or recruitment agency cancels the application after services have commenced, cancellation charges will apply
  • Cancellation fees cover work already performed, including sourcing, screening, document processing, and administrative costs
  • The amount of cancellation charges depends on the stage of the recruitment process at the time of cancellation
  • Any non-refundable expenses already paid to third parties (government fees, medicals, etc.) will be deducted

Cancellation by Employer:

  • If the employer cancels a recruitment request after VERO has started sourcing or processing, partial or full service fees may be retained depending on work completed
  • Employers are encouraged to finalize job requirements and hiring decisions before engaging VERO to avoid cancellation costs

Refund Processing:

  • Approved refunds will be processed within 14-30 business days from the date of approval
  • Refunds will be issued via the same payment method used for the original transaction
  • Bank transfer fees or currency conversion charges may apply and will be borne by the recipient

Confidentiality & Data Protection

VERO is committed to protecting the confidentiality and privacy of all parties involved in our recruitment services.

Mutual Confidentiality Agreement

By engaging with VERO's services, both parties (VERO and the client/employer/agency) agree to keep all shared information confidential, including but not limited to:

  • Candidate personal information, documents, and profiles
  • Employer company details, hiring requirements, and salary information
  • Contract terms, service agreements, and payment arrangements
  • Recruitment strategies, sourcing methods, and proprietary processes
  • Any sensitive business or personal data exchanged during the recruitment process

Prohibited Activities:

  • No Document Misuse: Employers, agencies, and third parties are strictly prohibited from misusing, copying, redistributing, or sharing candidate documents outside the scope of the hiring process
  • No Direct Hiring: Clients cannot bypass VERO to hire our candidates directly without prior written consent and settlement of applicable fees
  • No Reuse of Information: Candidate profiles, videos, resumes, and personal information cannot be reused for other purposes, shared with competitors, or stored beyond the recruitment period without consent
  • No Unauthorized Sharing: Employers cannot share candidate information with other companies, third-party recruiters, or individuals without VERO's approval
Breach of Confidentiality

Any breach of confidentiality, misuse of candidate data, or unauthorized sharing of information may result in:

  • Immediate termination of services
  • Legal action to protect candidate rights and VERO's business interests
  • Financial penalties as outlined in the service agreement
  • Reporting to relevant authorities for data protection violations

Data Retention:

  • VERO retains candidate and client data only for as long as necessary to fulfill our services and comply with legal obligations
  • Candidates may request deletion of their data by contacting us in writing
  • Employers must delete or return candidate documents if the hiring process does not proceed

Limitation of Liability

While VERO strives to provide the highest quality recruitment services, there are inherent limitations to what we can control or guarantee.

VERO is NOT Responsible For:
  • Work Performance: The job performance, conduct, absenteeism, or behavior of placed workers after employment commences
  • Workplace Issues: Workplace injuries, accidents, disputes, or conflicts involving recruited staff
  • Employer Treatment: How employers treat, manage, compensate, or accommodate hired workers
  • False Information: Inaccuracies, misrepresentations, or false information intentionally provided by candidates or external recruitment agencies
  • Immigration Decisions: Visa rejections, work permit denials, or immigration policy changes made by the Maldives government
  • Government Delays: Processing delays, quota limitations, or administrative issues within XPAT or Immigration systems
  • Third-Party Actions: Actions, omissions, or failures of external recruitment agencies, agents, medical centers, or other third parties
  • Candidate Withdrawal: Candidates who change their mind, refuse to travel, or back out after visa approval
  • Employer Changes: Job cancellations, requirement changes, or business decisions made by employers mid-process
  • Force Majeure: Events beyond our control including pandemics, natural disasters, political instability, travel restrictions, or government shutdowns

Liability Cap:

In no event shall VERO's total liability to any client exceed the total service fees paid directly to VERO for the specific recruitment service in question. VERO shall not be liable for any indirect, consequential, incidental, or punitive damages arising from our services.

Client Acknowledgment:

By using VERO's services, clients acknowledge that:

  • Recruitment is a facilitation service, not an employment guarantee
  • Final hiring decisions rest with the employer
  • Employee performance is the responsibility of the employer and the employee
  • Government decisions on visas and work permits are beyond VERO's control
  • Risks inherent to international recruitment exist and are shared between all parties

Dispute Resolution & Governing Law

VERO is committed to resolving any disputes or disagreements amicably and professionally.

Resolution Process

Step 1: Direct Communication

  • In case of any dispute, disagreement, or complaint, the first step is to contact VERO directly via email, WhatsApp, or phone
  • We encourage open and honest communication to understand the issue and work toward a resolution
  • Most issues can be resolved through constructive dialogue

Step 2: Mediation (if needed)

  • If direct communication does not resolve the dispute, both parties may agree to mediation
  • A neutral third party or industry mediator may be engaged to facilitate a fair resolution
  • Mediation costs are shared equally between parties

Step 3: Legal Action (last resort)

  • If mediation fails, either party may pursue legal remedies
  • Legal action should be considered a last resort after all other options are exhausted

Governing Law & Jurisdiction:

These Terms & Conditions and any disputes arising from VERO's services shall be governed by and construed in accordance with the laws of the Maldives. Dispute resolution mechanisms depend on different factors, including:

  • The nature and complexity of the dispute
  • The amounts involved
  • The parties' willingness to engage in alternative dispute resolution
  • Applicable Maldivian labor law, employment regulations, and commercial law

Where legal proceedings become necessary, both parties agree to the jurisdiction of the Courts of the Maldives for resolution.

Good Faith Commitment:

Both VERO and clients commit to resolving disputes in good faith, with fairness, professionalism, and respect for each party's interests.
